1. About these terms
These terms apply to every order, quote and account with BH Catering & Events (“BH,” “we”), whether placed online at order.bhcater.com, by phone or by email. By placing an order or creating an account, you agree to them. Online ordering is offered to corporate clients; for weddings and private events, please contact us directly.
When you order for a company, you confirm you are authorized to do so, and the company is bound by these terms. A written proposal for a staffed event may add terms of its own; where they differ, the proposal wins for that event.
2. Ordering, lead times and minimums
- Drop-off orders need at least 24 hours’ notice; seasonal menus such as Thanksgiving may need more, as shown when you order.
- Orders have a $300 minimum before tax and delivery. Many items carry their own minimum guest count, shown on the menu.
- An order is confirmed when you receive our confirmation email. We may decline or adjust an order we cannot fulfill, such as on a fully booked or closed date, and will tell you promptly.
- Seasonal items are available only during the dates shown, and menu items may sell out. Photos are for illustration; ingredients and presentation can vary with season and supply.
- Recurring orders repeat the same items and time on the schedule you choose. Each delivery is created about a week ahead at the menu prices then in effect, appears in your account, and follows the change and cancellation rules in section 5. You can stop a recurring order at any time.
3. Prices, taxes, delivery fees and tips
- Prices are in US dollars and are those shown when you place the order. We may change menu prices at any time; confirmed orders keep the price you were quoted.
- Massachusetts meals tax is added to food and beverage orders. Tax-exempt organizations must have a valid exemption certificate on file with us before ordering; otherwise tax applies.
- Delivery is charged by distance from our kitchen, shown at checkout before you pay.
- Plates, utensils, napkins and serving pieces are included with every drop-off order.
- Tips are optional and go entirely to our kitchen and delivery team.
4. Payment and company invoicing
Card payments. When you order by card, we save your card securely with our payment processor, Stripe, and charge it on your delivery date for the final order total, including any changes you made before then. You authorize us to charge that card for the order, any cancellation fee under section 5, and any charges under section 6. We never see or store your full card number.
Company invoicing. Companies may apply to be invoiced. Invoicing is available only after BH approves the account, and each approved account has its own payment terms (for example, Net 30) and credit limit, shown at checkout. Approved companies may choose invoice or card on each order. Invoices are emailed to the accounts payable address on file and are payable online or by check.
- Payment is due by the date on the invoice. Orders that would take an account over its credit limit must be paid by card.
- If an invoice is past due, we may pause invoicing for the account, require card payment on future orders, and refer unpaid balances for collection.
- Purchase order numbers are the customer’s responsibility to provide when its own process requires them; a missing PO does not change the amount owed.
5. Changes and cancellations
Ingredients are bought and prep begins days ahead, so the closer to delivery, the more a change costs us.

- Guest counts may be lowered until 72 hours before delivery and raised until 24 hours before, subject to availability. You can make these changes in your account or by calling us.
- Tips are not included in cancellation fees.
- In severe weather or if your office closes unexpectedly, contact us and we will work with you to reschedule.
- Event deposits and cancellations follow section 8 and your proposal.
6. Delivery, Signature Presentation and returned items
- We deliver to the address and time on your order. Please give accurate access details: loading dock, floor, building security and an on-site contact. Delays caused by traffic, weather or building access may happen; we will keep you informed.
- If no one is available to receive the order, we may leave it with building staff or at a reasonable spot and notify you. The order is charged in full.
- Drop-off orders come in disposable containers and are yours to keep.
- Signature Presentation uses our ceramic platters, wood boards and linen-lined baskets. It carries a return pickup fee equal to your delivery fee, and you choose a pickup window at checkout. Please have every item ready at that time. Items missing or damaged beyond normal use at pickup will be charged at replacement cost, and we will tell you before charging.
7. Food safety and allergies
- Allergies. Before placing your order, please tell us if anyone in your party has a food allergy. Our kitchen handles milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish and sesame. We take care with every request, but because all items are prepared in a shared kitchen, we cannot guarantee any item is free of allergens. Dietary labels (V, VG, GF) describe ingredients, not allergen-free preparation.
- Raw foods. Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness.
- Handling after delivery. Hot food arrives ready to serve. Perishable food should not sit at room temperature for more than 2 hours; refrigerate leftovers promptly. We are not responsible for food that is held, reheated or stored improperly after delivery.
8. Staffed events, quotes and bar service
- Quotes. Event pricing is set in a written proposal, valid until the date shown on it. An event is booked when you accept the proposal and pay the deposit.
- Deposits and balance. The deposit shown on the proposal secures your date. The final guest count and remaining balance are due 7 days before the event. Deposits are non-refundable within 14 days of the event.
- Gratuity. Gratuity for event staff is optional unless your proposal includes it, and any gratuity goes entirely to the staff who worked your event.
- Staff and the venue. Staff hours include setup and breakdown as listed in the proposal; added time is billed at the proposal’s hourly rates. You are responsible for venue access, permits your venue requires, and, for outdoor cooking such as BBQs and clambakes, confirming open-flame cooking is allowed.
- Bar service. BH provides alcohol under its Massachusetts caterer’s liquor license, served only by BH staff. Guests must be 21 or older and may be asked for ID. Our bartenders will refuse service to anyone underage or visibly intoxicated and may end bar service early if it becomes unsafe, without refund.
9. Accounts, emails and text messages
- Keep your sign-in details to yourself and tell us right away if you think someone else has used your account. You are responsible for orders placed through it.
- A company’s account administrator manages who can order for the company and who may charge orders to its invoice account. We may suspend or close an account that is not used for corporate ordering or that breaks these terms.
- We email order confirmations, changes, reminders and invoices; these are part of the service.
- If you opt in at checkout, we also send order updates and delivery reminders by text. Message and data rates may apply. Reply STOP to opt out or HELP for help. Message frequency varies by order.
- How we collect and use your information is described in our Privacy Policy.
10. Liability and general terms
- If something is wrong. Tell us within 24 hours of delivery if an order is missing items or not as ordered, so we can make it right with a credit, refund or replacement.
- Our liability. To the extent the law allows, our total liability for any order is limited to the amount you paid for that order. We are not liable for delays or failures caused by events beyond our reasonable control, such as severe weather, road closures or power outages.
- Governing law. These terms are governed by the laws of the Commonwealth of Massachusetts.
- Changes to these terms. We may update these terms; the version posted when you place an order applies to that order.
